Terms and Conditions

The premises are accepted by the User as being in good condition and repair, and they agree to leave them in a clean and tiday condition at the end of each use of them. The User will reimburse the Congregation the costs of making good any damage to the premises or surrounding property through the use of the premises.

The Congregation's current policy with the Church of Scotland Insurance Company (COSIC) includes legal liability cover for individuals who hire the premises for occasional social events. However, if a claim arose, COSIC advise that they would start by seeking to establish if that individual might have cover under the home contents section of his or her home insurance policy. Organised groups, clubs, etc. must have their own insurance.

The User shall be responsible for providing adequate insurance cover for themselves, those associated with them, and their equipment and any other property they bring into the premises in connection with their use of them and, if required, shall exhibit the relevant policies and premium receipts to the Congregation. Without prejudice thereto and to the other provisions of this agreement the User shall be responsible for providing adequate public liability insurance cover in respect of their use of the premises.

The User is aware of the legislation relating to the safeguarding of children and young people and has read and understood the relevant Church of Scotland Safeguarding materials and will follow its provisions. The User has adopted a recruitment procedure for working with children and young people which, where appropriate, includes requiring staff (whether employees or volunteers) to be members of the Protection of Vulnerable Groups Scheme as laid down by the Protection of Vulnerable Groups (Scotland) Act 2007. If the User is found to be in breach of these undertakings, the Congregation shall have the right to terminate this Agreement with immediate effect.

The User is aware of the legislation relating to regulated work with protected adtulas and has read and understood the relevant Church of Scotland Safeguarding materials and will follow its provisions. The User has adopted a recruitment procedure for working with children and young people which, where appropriate, includes requiring staff (whether employees or volunteers) to be members of the Protection of Vulnerable Groups Scheme as laid down by the Protection of Vulnerable Groups (Scotland) Act 2007. If the User is found to be in breach of these undertakings, the Congregation shall have the right to terminate this Agreement with immediate effect.

The User shall not make any alterations to the premises.

This agreement can be terminated by either party giving the other three months' notice in writing.

In the case of single user payment must be made no less than three working days prior to the date of use. For repeated use the User will be invoiced monthly in advance. Due notice shall be given by the Congregation in writing of any change in rent.

The Users confirm that they are aware of their duty to appoint a 'Responsible Person' in terms of the Fire Safety Regulations, and that they have noted their obligations in the areas of Health & Safety, and Food Hygiene.
